In the mid 1970s, a nursing educator in Idaho had contact, through a student, with a female client who had chronic myelogenous leukemia. This form of leukemia can often be managed for years with little or no chemotherapy. The woman had done well for about twelve years and ascribed her good condition to health foods and a strict nutritional regime. However, her condition had turned worse several weeks before and her physician had advised her that she needed chemotherapy if she were to have any chance at survival. The physician had also advised her of the potential side effects of the therapy including hair loss, nausea, fever, and immune system suppression.
The woman consented to the therapy and signed the appropriate forms, but later, she began to have second thoughts. The nursing educator and student had given the patient one dose of the therapy when the woman began to cry and express her reservations about the therapy. She questioned the nurse about alternative treatments to the use of chemotherapy. The patient related that she had accepted the therapy because her son had advised her that this was the best treatment. She related that she had not asked about alternate forms of treatment as the physician had indicated that chemotherapy was the only treatment indicated. The nurse did not discuss the patient's concerns with the physician, and later that evening, she talked to the patient about alternate therapies. In the discussion, rather nontraditional and controversial therapies were covered including reflexology and the use of laetrile. During the talk, the nurse made it very clear that the treatments under discussion were not sanctioned by the medical community.
The patient's feelings toward alternate therapies were strengthened by the evening's conversation; however, she continued with chemotherapy. The treatments, however, did not bring remission to her crisis and she died two weeks later. Upon hearing about the conversation between the off duty nurse educator and his patient, the physician brought charges against the nurse for unprofessional conduct and interfering with the patient-physician relationship. In the mid 1970s, a nursing educator in Idaho had contact, through a student, with a female client who had chronic myelogenous leukemia. This form of leukemia can often be managed for years with little or no chemotherapy. The woman had done well for about twelve years and ascribed her good condition to health foods and a strict nutritional regime. However, her condition had turned worse several weeks before and her physician had advised her that she needed chemotherapy if she were to have any chance at survival. The physician had also advised her of the potential side effects of the therapy including hair loss, nausea, fever, and immune system suppression.
The woman consented to the therapy and signed the appropriate forms, but later, she began to have second thoughts. The nursing educator and student had given the patient one dose of the therapy when the woman began to cry and express her reservations about the therapy. She questioned the nurse about alternative treatments to the use of chemotherapy. The patient related that she had accepted the therapy because her son had advised her that this was the best treatment. She related that she had not asked about alternate forms of treatment as the physician had indicated that chemotherapy was the only treatment indicated. The nurse did not discuss the patient's concerns with the physician, and later that evening, she talked to the patient about alternate therapies. In the discussion, rather nontraditional and controversial therapies were covered including reflexology and the use of laetrile. During the talk, the nurse made it very clear that the treatments under discussion were not sanctioned by the medical community.
The patient's feelings toward alternate therapies were strengthened by the evening's conversation; however, she continued with chemotherapy. The treatments, however, did not bring remission to her crisis and she died two weeks later. Upon hearing about the conversation between the off duty nurse educator and his patient, the physician brought charges against the nurse for unprofessional conduct and interfering with the patient-physician relationship. In the documentary The Invisible Patients, Jessica, a nurse practitioner for home-limited patients, is faced with several ethical dilemmas. For example, Jessica provides care for an elderly couple named Wink and Patty Sherrill. Both Patty and Wink are prescribed narcotics to manage their arthritis pain. During a routine urine drug screen, it is discovered that Patty does not have any trace of her pain medication in her system, yet she is still having her narcotic prescription refilled regularly. This obviously raises concerns for medication diversion. Patty is presumably giving her narcotics to her husband or selling her narcotics, which is a clear violation of her pain contract. She is banned from her primary care MD’s practice, which causes her great difficulty in finding another healthcare provider. Jessica feels that it is her responsibility to provide care for this couple.
This scenario raises the ethical dilemma of beneficence versus nonmaleficence. The principle of beneficence is “the duty to do good and prevent or remove harm" (Hamric, Hanson, Tracy, O'Grady, 2014, p. 337). Prescribing narcotics to those experiencing chronic pain and disability is a necessary and beneficent act of healthcare providers. The principle of nonmaleficence is “the duty not to inflict harm or evil” (Hamric et al., 2014, p.337). Prescribing narcotics to a patient who is suspected of narcotics diversion has the potential to cause harm to the person who is taking the narcotics illicitly. Jessica must now decide which principle to follow and which principle to potentially break. Jessica decides that even though Patty is abusing her prescription, she does in fact still need her narcotics and continues to prescribe the pain medicine.

Solution
In this scenario, I would not continue to prescribe Patty narcotics. Since she is not taking her pain medications but still seeking refills, she is abusing her prescription and the trust placed in her. If she is diverting her narcotics to her husband and/or selling them on the street, this places Wink and/or the narcotic abuser at risk for health complications such as respiratory depression, constipation, drug dependence, increased tolerance, and narcotic withdrawal in the future. I believe Wink has a legitimate need for pain medications, but he should be honest and open with Jessica about the need to increase his pain medications or try different modalities if his pain is not properly controlled. Regardless of motive, illegally diverting narcotics is a breach in contract and should not be overlooked.
If I were presented with this scenario, I would have talked with Patty and Wink about Patty’s narcotic diversion and sought an alternative solution to continuing to prescribe narcotics. If Patty were in fact giving her narcotics to her husband to help control his pain, I would adjust Wink’s medications and pain management strategy. If they were selling their excess n.

Ethics are guided by the core principles to which most of our society agree. The devil is in the details, however, as we will see in specific instances.
Autonomy
The principle of autonomy ties into patients' rights to self-determination, or the right to make their own fully informed choices about their care; treatments they may accept or reject; and the ultimate consequences of their choices. The freedom to choose our own course of action is highly cherished in our society. However, what if the choice involved taking a life, whether by suicide or homicide? What happens when one person's desires or choices bump up against another's? These gray areas are the turf on which ethical issues play out. An example of an ethical dilemma surrounding autonomy occurs when a patient denies a lifesaving medical treatment. What if the person refusing treatment is legally a child who refuses chemotherapy for a curable cancer, all because of religious beliefs? Does the child know that without treatment death is likely? Does the child understand death well enough to make the choice? What if the parents are making this choice on behalf of their child, which is often the case? Does the principle of autonomy extend to treatments that are curative and life-saving, yet conflict with deeply held religious or personal beliefs? What role should government play in order to protect its citizens, even from themselves? Autonomy can be a minefield of conflicting values, views, and actions.
Beneficence
The principle of beneficence requires that all actions taken on behalf of a patient are designed to provide good outcomes. Seem obvious? Focus on the question of what constitutes a "good outcome." A 76-year-old man has fallen on ice, struck his head, and has suffered severe brain damage from the resultant bleeding into the brain. He is still able to respond to painful stimuli, breathe on his own, and maintain blood pressure and other bodily functions. However, the cerebral cortex is permanently damaged. The family and the physician huddle to discuss what steps to take next. What is the beneficent approach? It is possible to sustain life in this patient since his brain stem is intact and he does not meet the criteria for brain death. Should he be given fluids and nutrition through tube feedings? If he develops pneumonia, should it be treated? Should he be left alone with minimal comfort measures to see what his body will do as the injury unfolds? Should all interventions be withheld? Would it do the patient more harm to continue all measures, or to stop all measures? What are the patient's wishes, as expressed by his surrogate, in a situation such as this? Beneficence can be a tricky concept, since what is helpful and indicated in one situation may be a terrible choice in another. The question of the definition of "good outcome" may be wildly different from various perspectives of the family, the physicians, the patient himself, and the hospital.

Should Physician-Assisted Suicide Be Legal?
In 1997, Oregon became the first state to enact the Death with Dignity Act (DWDA).
This act allows a person with a terminal illness to make the decision to end their own life with a
lethal medication prescribed by a physician. Since then, only four other states have legalized
physician-assisted suicide. I’m interested in this topic for two reasons. The first being I am
currently making a career change and going back to school for nursing. I ultimately want to
become a hospice nurse. I believe this is a very relevant topic in the field of providing comfort
care to terminally ill patients. The second reason is because my grandpa died of lung cancer and I
spent the majority of his last three months taking care of him. His time between diagnosis and
when he passed was very quick but also very painful. I can’t imagine if he had lived for another
year or more how difficult it would have been for him, myself, and my family. We never
discussed the option of physician-assisted suicide because it is not an option in the state of Ohio.
My grandpa had a passion for life and living it to the fullest. Knowing him well, I think if the
option had been available, it would have been something he would have considered. I wanted to
dive into this topic and find out why in the past eleven years this law has only been passed in five
states. So, I decided to do some research of my own to find out the answer to my question:

When I started researching this topic, I found a lot of opposition. There are many reasons
people are against physician-assisted suicide. One being religious reasons. Religious

organizations argue that human life is sacred and someone ending their own life, no matter the
circumstances, is morally and spiritually wrong (“Right to Die” 2). The American Medical
Association also objects to physician-assisted suicide. They argue that physicians are meant to
heal not kill (2). Another argument states that allowing physician-assisted suicide would leave
people with mental and physical disabilities open to being coerced into ending their own lives. If
someone believes they may be a financial or physical burden on their family, they may be
tempted to consider physician-assisted suicide simply to relieve that burden. Some people think
instead of helping people die, doctors and policy makers should be working on improving end-
of-life care (2). There is also an argument that minorities have less access to health care and
receive less treatment as a result. This may make a pill to end their lives feel like the only option

The human struggle to survive and dreams of immortality have long been instrumental in inspiring medicine to develop the means to prevent and cure illness. Advances in medical technology have resulted in the power to prolong a productive life, as well as to delay inevitable death. Those victims of long-term pain and suffering, as well as patients in vegetative states and irreversible comas, are the most directly affected. A longer survival involves considerable cost and can therefore be a substantial financial burden to the family and the government. Is it worth it? How do we make a judgment about quality of life? What is the financial value of another day, week, or year of life? Should we assume that younger years are better than older years? The following reality check provides some perspective as to how one might respond to the preceding questions.
End of Life or Beginning of Life?
My mother is 92 years old, and she is more active and is enjoying life more than when she was much younger. Her advanced age has actually proven to be something of an advantage, as it has given her the time and freedom to do some of the things she couldn’t do while she was raising a family. It has been a joy to me, as her son, and to the rest of the family to witness her joy and vigor. Even strangers have found her stamina to be an inspiration as to the value of the end years of life. Three years ago, however, it wasn’t so. Mother was critically ill, comatose on a respirator in an intensive care unit. Survival was not considered likely. I am embarrassed to say that I was making arrangements for a funeral. I am even more embarrassed because I am a physician and did not see how she could survive for long except as a vegetable. Then the unlikely occurred. She recovered! Welcome back to our final day of class. Today, we are going to discuss end-of-life issues and professional liability insurance.
Advances in medical technology have resulted in the power to prolong a productive life as well as delay inevitable death. A longer survival involves considerable cost and can therefore be a financial burden to the family and the government. Is it worth it?
As long as we are alive we have value.
We will discuss the patient’s autonomy and one’s right to choose when to proceed with treatment or discontinue it.
Let’s first discuss end-of-life issues.
Does medical ethics require a patient’s life be preserved at all costs and in all circumstances?

No. The ethical integrity of the medical profession allows for competent patients to decide for themselves whether a particular treatment is in their best interest.

: In addition to what has already been noted, I would say that court involvement would be mandated only to appoint a guardian in one of the following cases:

Belchertown State School v. Saikewicz,
which held that such different factors as the patient’s mental impairment and his or her medical prognosis with or without treatment must be considered before judicial approval is necessary to withdraw or withhold treatment from an incompetent patient.
Saikewicz was a mentally retarded sixty-seven year old man with leukemia and a grim prognosis. The court appointed a guardian recommended to the court after the court allowed the chemothera.

So, you think i’m crazy
- 1. To Show or Not to Show—That is the Question or should it be…… The Patient’s Right to access Medical Records Or is it? Presented by: Kayla Poret, RN, WCC
- 2. Meet Claire Claire is a 38 year old woman who has never married. She has worked as a secretary off and on over the past ten years. She has difficulty keeping jobs due to disputes with fellow workers. She often accuses them of not carrying their work load, criticizes their work, and in one case she reported a fellow worker to the supervisor for coming to work late. Out of work, she is seeing a psychiatrist at the mental health clinic using the HMO of her previous employer. She pays out of pocket in order to keep the HMO coverage.
- 3. After four appointments with Claire, Dr. E identified patterns of paranoid thinking and determined her to be an unpleasant and difficult patient. She was not psychotic, nor did she have major psychiatric disorders. But she did exhibit personality traits that are causing her problems. Meet the Man with the answers,Dr. EvalUator
- 4. And the visits continue…. At the end of visit four, Claire is convinced Dr. E does not like her. She thinks he is implying that her employment problems are her own fault and that she needs further therapy to address these issues. She suspects that Dr. E is keeping notes on her that reflect his poor opinion of her. She is certain he is trying to make it hard for her to get future jobs and has written his opinion in her chart. She asks to see her medical record.
- 5. OMG, what if I let her see what I wrote in this chart….. When Dr. E hesitates, she states she will report him to the management of the HMO. The law is currently in flux regarding rights of patients to see their medical records. Moral uncertainty exists. In particular, many physicians, especially psychiatrists, are concerned that granting patients the right to see their records may harm patients as well as violate the privacy rights of the provider. Regardless of the legal wrangling, what is an ethically appropriate decision by Dr. E?
- 6. And the dilemma shows its ugly face Should Dr. E show Claire her medical record or not? She may not like what she will see…
- 7. Come on People: Of course he should allow her access Claire has a Right!
- 8. And the Ethical Dilemma Game Begins…
- 9. Ethical Principles: Accountability-accepting responsibilities for one’s actions
- 10. Both solutions offer positive and negative consequences.. That is what makes it an ethical dilemma.. Allowing Claire to see her record Positive—Claire’s trust may increase with Dr. E., She has a right to see it. Her autonomy will be enhanced due to her being involved in her treatment and POC. Negative—Claire’s feelings may be hurt, Dr. E’s evals of Claire will be revealed (he did think she was a difficult patient). Not allowing Claire to see her record Positive—it will save Claire the potential for reading psych notes that may confuse her and increase her paranoia. Dr. E’s privacy will be protected. Negative—Claire’s rights will not be honored. A legal issue may arise in Dr. E’s future. Claire’s paranoia may increase. What is Right for the Patient What is Right for the Doctor
- 11. Now, as a HCP, what is Dr E’s Responsibility to Claire?
- 12. DO NO HARM: NONMALEFICENCE
- 13. Autonomy: the freedom to make decisions for oneself Which one? Claire’s decision proceeds all others! --Nurses and doctors have to support the patients method of decision making --A Second opinion may be the case of needing her medical records --Control is needed in this situation by Claire, and retrieving her medical records is something that she has control over.
- 14. Beneficence: demands that good be done for the benefit of others What will benefit Claire? Seeing her records will benefit her. It is apparently a need in her life at this time in order to feel involved in her care. She initiated the request. Yes, she is paranoid, but she is still a human with rights and this will benefit her by heightening her right to Self Determination (Provision 1:2 of the ANA Code of ethics). It is our duty as a HCP to support her decision making, unless it causes her physical or emotional harm. As nurses, our primary commitment is the patient (Provision 2 of the ANA Code of Ethics). At this point, she feels helpless and needs to participate in her own care. She is not gaining benefit from the previous Plan Of Care.
- 16. According to the Journal of the Royal Society of Medicine, September 1988 (Article 81: 520-522) a study showed, One paranoid patient described feeling angry when he had read nursing comments on his reaction to a relative’s visit, but found that reading the comments enabled him to discuss the situation more openly with his key worker.
- 19. His priority should be Claire’s wishes over any internal feelings he may have.
- 20. The HIPPA form filled out in his office was an agreement that Claire could have her medical records.
- 21. Claire may have the need to get a second opinion and it is Dr. E is accountable to release it to her per her request.
- 22. Dr. E is considering putting his practice in a legal battle if he refuses to be accountable for releasing what is rightfully Claire's
- 23. Dr. E. has to honor Claire’s right to informed consent
- 27. Dr. E. makes the decision to allow Claire access to her medical records and offers to discuss them with her…… He chooses to honor the Ethical Principles on which he practices and grants Claire’s wishes to obtain a copy of her medical records. And, he also makes $0.47 a sheet on the medical record copied for Claire.
